Terms of Use

These Terms of Use ("Terms") are an agreement between you and Freehand Pte. Ltd., a company registered in Singapore and operating "Merdown" ("we", "us", or "our"). They govern your download and use of the Merdown macOS application.

By downloading or using Merdown, you agree to these Terms. If you do not agree, do not use the application.

1. Licence

Subject to these Terms and the applicable Mac App Store terms, Freehand Pte. Ltd. grants you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use Merdown on Apple devices that you own or control.

2. Your files and content

You keep all rights in the documents, diagrams and repositories you open or create with Merdown. You are responsible for ensuring that you have the right to use that content and for maintaining suitable backups. Merdown is not a backup service.

3. Acceptable use

You agree not to:

  • Use Merdown for an unlawful, harmful or abusive purpose;
  • Interfere with the operation or security of Merdown or the Mac App Store;
  • Circumvent technical protections or use Merdown in a way that infringes another person’s rights; or
  • Copy, resell or distribute Merdown except as permitted by law or the applicable App Store terms.

4. Third-party software and services

Merdown may include or interact with third-party software, formats and services, including Mermaid, Git, macOS and the Mac App Store. Those products may be governed by separate licences or terms. Freehand Pte. Ltd. is not responsible for third-party products or changes to them.

5. Updates and availability

We may provide updates that add, change or remove functionality. We may also discontinue Merdown or particular features. We do not promise that every version will remain compatible with every macOS release, document or repository.

6. Purchases and refunds

Purchases, billing and refunds are handled by Apple and are subject to the applicable Mac App Store terms. Prices and availability may vary by country or region.

7. Disclaimers

Merdown is provided "as is" and "as available". To the maximum extent permitted by law, Freehand Pte. Ltd. excludes all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that Merdown will be uninterrupted, error-free or suitable for every file or workflow.

Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded, including mandatory consumer protections that apply to you.

8. Limitation of liability

To the maximum extent permitted by law, Freehand Pte. Ltd. will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, profits, business or goodwill arising from your use of Merdown. Where liability cannot be excluded, our total aggregate liability will not exceed the greater of the amount you paid for Merdown in the 12 months before the claim or GBP 50.

9. Termination

You may stop using and uninstall Merdown at any time. Your licence ends automatically if you materially breach these Terms. Provisions that by their nature should survive termination, including ownership, disclaimers, liability and governing-law provisions, will continue to apply.

10. Governing law

These Terms are governed by the laws of Singapore, without limiting any mandatory consumer rights or remedies available under the laws of your country of residence.

11. Changes to these Terms

We may update these Terms from time to time. The current version will be published on this page with a revised last-updated date. If a change materially affects your rights, we will take reasonable steps to provide notice where required.
